Terms of Service

By creating an account or using ActivityBuilder at activitybuilder.org and its apps (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you use the Service for an organization, you confirm you have authority to accept these terms for it. If you don't agree, don't use the Service.

ActivityBuilder is a subscription platform for activity directors and staff in senior living communities. It includes activity ideas, planning and calendar tools, newsletters, TV screens, live games, a family portal and AI-assisted content. Features may change over time as we improve the Service.

Plans. Individual plans are billed monthly or annually at the price shown at checkout. Organization plans are quoted separately.

Free trial. New customers may receive a free trial. The trial length is shown at checkout before you pay. Free trials are for new customers only; returning customers are charged when they subscribe, and checkout tells you this before you pay.

Automatic renewal. Your subscription renews automatically at the end of each billing period (or at the end of your free trial) and your payment method is charged the then-current price until you cancel. By subscribing, you authorize these recurring charges. We send a confirmation email with your plan, price, first charge date and how to cancel.

Price changes. If we change the price of your plan, we will tell you in advance, and the new price applies from your next billing period. You can cancel before it takes effect.

Taxes. Prices do not include taxes unless stated. You are responsible for any applicable taxes.

You can cancel at any time online in Account → Subscription, or by emailing support@activitybuilder.org. When you cancel, your subscription stops renewing and you keep full access until the end of the period you have already paid for (or the end of your free trial, with no charge). You'll see a confirmation showing the date your access ends.

Payments are non-refundable and we do not give refunds for partial billing periods, except where required by law. If a payment fails, we may suspend access until the balance is paid.

You are responsible for keeping your login details secure and for activity under your account. Each subscription is for one facility and is subject to the device limits of your plan. Staff you invite to your account must accept the invitation, and you are responsible for their use of the Service.

You keep ownership of the content you add to the Service. You give us permission to host, process and display it only as needed to provide the Service to you.

If you enter information about residents, upload photos, or invite family members, you are responsible for having the authority, notices and consents required to do so, including consent for photos. ActivityBuilder is an activity-planning tool, not a medical record system. Don't enter diagnoses, medications or other medical records. If you need a Business Associate Agreement, contact us before entering any protected health information.

You agree not to: access other users' data or attempt to bypass security; use the Service to send spam or unsolicited email, or email people who haven't agreed to hear from your facility; upload unlawful, harmful or infringing content; overload, disrupt or reverse engineer the Service; scrape or bulk-download content with automated tools; or resell access. We may limit sending volumes and usage to protect the Service.

Some content is generated by AI. It can be inaccurate or unsuitable for a particular resident, so review it before use and adapt activities to your residents' abilities and care plans. Nothing in the Service is medical, legal or professional advice.

The Service and its content, including activities, games, templates, designs and written materials, belong to ActivityBuilder or its licensors. While your subscription is active, we give you a limited, non-transferable license to use that content for activities within your facility. You may not redistribute it outside your facility.

Some features connect to third-party services, such as Stripe or PayPal for payments and Zoom for meetings. Your use of those services is subject to their terms.

We may suspend or close accounts that break these terms, create security risks, or have unpaid balances. You can stop using the Service at any time. After your account closes, we handle your data as described in our Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law. We do not guarantee uninterrupted or error-free operation, or that content will meet every professional requirement.

To the maximum extent permitted by law, ActivityBuilder will not be liable for any indirect, incidental, special or consequential damages, or lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

We may update these terms. If we make material changes, we will notify you by email or with a notice in the Service before they take effect. If you continue to use the Service after that, the updated terms apply.
